The above named were detained at 14:15 hrs on Saturday 8 March in Palenque,
state of Chiapas, by members of the judicial police and public security.
Jerónimo Hernández López and Gonzalo Rosas Morales were forcibly removed
from the vehicle in which they were travelling, bundled into a police car
and taken to an unknown destination, where they were reportedly beaten and
ill-treated. All seven detainees were "disappeared" for several hours.
The Diocese of San Cristóbal de las Casas, to which Jerónimo Hernández and
Gonzalo Rosas belong, were able to visit the detainees, in a prison in
Tuxtla Gutiérrez in the afternoon of 9 March. Both showed signs of having
been beaten. All detainees have been charged in connection with a reported
attack which took place on 7 March, where two police officers were shot
dead. The attack allegedly took place shortly after police officers had
helped disperse a peasant demonstration regarding a land dispute.
Jerónimo Hernández is director of the Comité de Defensa de las Libertades
Indígenas (Committee for the Defence of Indigenous Freedoms) and Gonzalo
Rosas Morales is a leader of Xi'nich (which means "ants' march" in the
Ch'ol language), an indigenous human rights organization.
BACKGROUND INFORMATION
On 7 March 1997 tensions flared after hundreds of armed police remove
peasants from two local communal farms, they had occupied since 1994. Hours
later peasant members of Xi'nich blocked a local highway to protest the
police operation and demand the release of the people arrested. The protest
was reportedly violently broken up by police backed by helicopters.
The municipal authorities in Palenque unfoundedly accused grass root
activists of participation in the killings, following a long lasting
problem of persecution and human rights violations against human rights
defenders and Indian rights activists who are often accused by the
authorities in commun crimes, as a mean of curtailing their activities.
The Diocese at San Cristóbal express in a statement "an energetic protest
against this new and arbitrary act against pastoral agents of the Catholic
church in Chiapas" and added that the two priest were in Palenque at the
time of the ambush after having taken part in a religious conference.
RECOMMENDED ACTION: Please send telegrams/telexes/faxes/express/airmail
letters in Spanish or your own language:
-expressing concern at the reported torture of the above mentioned people
(naming some of them)by members of the security forces;
- asking for all the detainees to be immediately released unless they are
charged with a recognizable offence;
-calling for a prompt and impartial investigation into these allegations
and for those responsables to be brought to justice, asking to be kept
informed of the outcome of these investigations;
- urging immediate measures to ensure the physical and mental integrity of
all detainees and seeking assurances that all arte being humanely treated
and allowed immediate access to doctors, their relatives and lawyers;
-calling for an inmediate end to the impunity from which the perpetrators
of human rights violations in the context of the Chiapas conflict have thus
far benefitted.

El día de hoy a las 14:15 hrs. en la ciudad de Palenque Chis. fueron detenidos
arbitrariamente los sacerdotes jesuitas Jerónimo Alberto Hernández López y
Gonzalo Rosas Morales que laboran en la diócesis de San Cristòbal de Las
Casas.
Según los testigos, policías vestidos de civil, presuntamente policías
judiciales, respaldados por elementos de la policía de Seguridad Pública
bajaron con violencia de sus vehículos a los sacerdotes y sus acompa–antes
en las calles de Palenque, y a los primeros los introdujeron en una
patrulla y "ordenaron a los acompa–antes que se largaran (sic.)".
Supuestamente fueron trasladados a Tuxtla Gutiérrez y hasta el momento se
desconoce su paradero. En el momento de ser detenidos no les fue mostrada
ninguna orden de aprehensión ni se les expresa el motivo de su detención.
Por vía telefónica un funcionario de Seguridad Pública afirmó que se les
acusa de participar en una emboscada que sufrió el cuerpo de Seguridad
Pública el día de ayer a las 17:00 hrs. en la que, según comunicado del
gobierno del estado, murieron dos policías y otros cinco fueron heridos.
La Diócesis de San Cristòbal de Las Casas expresa una enérgica protesta por
este nuevo
acto de arbitrariedad en contra de agentes de pastoral de la Iglesia
Católica de Chiapas, en la persona de los sacerdotes jesuitas Jerónimo
Alberto Hernández López y Gonzalo Rosas Morales que evidentemente no
tuvieron relación alguna en los eventos de violencia, puesto que, habiendo
participado en la Asamblea Diocesana en la ciudad de San Cristóbal de Las
Casas, realizada del martes 4 al jueves 6 de marzo, no se encontraban en
donde las autoridades afirman.
De igual manera la Diócesis considera que no es persiguiendo a la Iglesia
católica, ni
creando nuevas situaciones de violencia, ni actuando en función de acusaciones
evidentemente falsas, como se logrará establecer condiciones de convivencia
pacífica y
respeto a la ley y al derecho de los pobres.
Las condiciones de guerra de baja intensidad que sufre el estado de
Chiapas, particularmente en la Zona Norte, evidencian que no se están dando
los pasos necesarios para solucionar las causas que originaron el
conflicto, sino que se sigue recurriendo a los antiguos métodos que hacen
cada vez más inalcanzable el establecimiento del estado de derecho.
Esta nueva acusación se inscribe en una serie de acontecimientos que hemos
dado a conocer oportunamente y que seguramente se incrementarán para
desviar la atención del hecho fundamental que es la crisis del proceso de
diálogo y negociación.

El Centro de Derechos Humanos "Fray Bartolomé de Las Casas" expresa su profunda
preocupación por la detención arbitraria y desaparición de los sacerdotes
jesuitas
Jerónimo Alberto Hernández López y Gonzalo Rosas Morales y exige a las
autoridades su inmediata aparición y puesta en libertad.
El Centro de Derechos Humanos "Fray Bartolomé de Las Casas" ha tenido
conocimiento de la detención arbitraria y violenta de los sacerdotes
jesuitas Jerónimo Alberto Hernández López y Gonzalo Rosas Morales
perpetrada el día de hoy sábado 8 de marzo a las 14:15 hrs. por presuntos
elementos de la policía judicial del estado y elementos de la policía de
Seguridad Pública. Fueron trasladados en vehículos de la policía con
paradero desconocido.
Abogados de este centro de derechos humanos se transladaron el día de hoy a las
instalaciones de la Procuraduría General de Justicia del Estado y se
entrevistaron a las 18:30 hrs. con autoridades competentes quienes negaron
categóricamente tener conocimiento del caso.
Mientras tanto, en el atrio de la Iglesia de la ciudad de Palenque,
elementos de la policía de Seguridad Pública realizaron un mitin con dos
féretros, gritando consignas y amenazando a los religiosos que ahí se
encontraban.
De manera extraoficial, a las 20:00 hrs., mediante un amigo en los medios
de comunicación, se pudo saber que las autoridades mentían y que en efecto
se encontraban tanto los dos sacerdotes como tres personas más de nombres
aún desconocidos, en las oficinas de la Procuraduría estatal.
A pesar de haber intentado obtener información directa del Sr. Gobernador
sustituto, del Sr. Procurador de Justicia del Estado, de la secretaría de
Gobierno, de las oficinas de
Comunicación Social del Estado y de otras dependencias competentes, en
todas ellas ha sido imposible tener acceso.
Al cierre de este boletín urgente no se ha podido esclarecer con certeza la
ubicación de los cinco presuntos detenidos-desaparecidos.
Cabe recordar como antecedentes inmediatos la emboscada que sufrieron
miembros de este Centro de Derechos Humanos en conjunto con civiles de la
Estación Norte, perpetrada por paramilitares con el auspicio de elementos
de la policía de Seguridad Pública; los desalojos violentos en varios
predios de los municipios norte±os y las acusaciones en contra de miembros
de la Iglesia católica emitidas por autoridades federales.
Es evidente que estas detenciones-desapariciones no son una azarosa
confusión. Se trata de
un hecho más de la Guerra de Baja Intensidad que padece nuestro Estado y
que pretende confundir los planos reales del conflicto en Chiapas.
Solicitamos la inmediata aparicion y puesta en libertad de los
detenidos-desaparecidos.

At last, State Authorities recognize the detention of two priests and two
campesinos
After being missing for almost 20 hours, Mr. Francisco González Gutiérrez
and Mr. Ramón Parcero Martínez, campesinos, along with Jesuit priests Fr.
Jerónimo Alberto Hernández López and Gonzalo Rosas Morales were found by
human rights lawyers Pilar Noriega, José Montero and Frederico Anaya in the
offices of the State Attorney General. These attorneys, representing the
Diocese of San Cristóbal de Las Casas and the Society of Jesus, had
searched for the whereabouts of the detained since minutes after their
detention yesterday afternoon (Saturday, March 8).
The detained, who supposedly are being held for an arraignment hearing
("presentados"), showed signs of having been beaten, especially so in the
case of Mr. Francisco González and the priest Jerónimo Hernández López.
At the time of the writing of this bulletin it has not been possible to
clarify the motive for which these individuals have been detained.
According to account of events told by Fr. Gonzalo Rosas, he was detained
by armed civilians and police, transported in a sedan vehicle without
license plates to the Palenque airport and their taken by helicopter to the
capital city of Tuxtla Gutiérrez, where he was hidden in the offices of the
State Attorney General and left incommunicado until 11:00 am today.
The other three persons detained were transferred by land and arrived to
the State Attorney's offices after 10:00 p.m. last night. While being
transported to the capital the detained were beaten by members of the State
Security Police.
In spite of the constitutional right which prohibits any detained person
from being held incommunicado, for the lawyers of the Dioceses of San
Cristobal de Las Casas, as well as the Religious superiors of the Jesuits,
and with addition obstruction to the Co-adjutor Bishop, Don Raúl Vera
López, o.p., all efforts at communication and juridical access were
impeded by local and state officials. In the same way, these
individuals suffered maltreatment while being detained and do not know why
they have been accused.
This Center demands that the authorities act in a responsible manner as
civil authorities who supposedly ought to procure justice; further, that
they cease and desist in the fabrication of charges and stop acting as
accomplices of those who deny the realization of changes which the country
needs in order to establish, at last, a state of law.
